17 Aug 2006 Children and the Law - the rights of a Minor, Melbourne
Can minors give or refuse consent to treatment? If so, at what age? Does it depend on the nature of the procedure? What do I do when parents or guardians disagree with my recommended treatment? What do I do when parents disagree with each other?
What do I do when I believe that the treatment requested by the parents is not in the child’s best interests? These are some of the many complex questions that will be explored in this session.
How both Common Law and Parliament-made Law influence these dilemmas will be discussed. The competing rights of patients, parents/guardians and doctors will be covered as well as the key topics of consent, privacy, fertility/reproductive matters and mandatory reporting. Participants will discuss case studies to develop strategies for dealing with these potentially difficult situations.
